Terms of Service
These terms govern your access to and use of FinAccounting’s finance and accounting application (the “Service”). By creating an account or using the Service, you agree to these terms.
Acceptance of terms
By accessing or using the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.
The Service
The Service is a business finance and accounting tool covering accounting, payroll, sales, purchases, reporting, and related functionality. We may add, change, or remove features from time to time. We do not guarantee the Service will be available at all times or free from interruption.
Accounts & your responsibilities
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You are responsible for the accuracy of the financial, payroll, and business data you or your organization enters into the Service. The Service is a tool to help you record and organize that data — it does not substitute for professional accounting, tax, or legal advice.
- You must notify us promptly of any unauthorized use of your account.
Acceptable use
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service or another user’s account/company data; interfere with or disrupt the integrity or performance of the Service; or reverse-engineer, decompile, or attempt to extract the source code of the Service except as permitted by law.
Your data
You retain ownership of the business and financial data you enter into the Service. You are solely responsible for maintaining your own backups or exports of your data where such capability is made available in the Service. We recommend regularly exporting or backing up critical records.
Intellectual property
The Service, including its software, design, and branding, is owned by FinAccounting and protected by intellectual property laws. These terms do not grant you any ownership rights in the Service itself — only a limited right to use it as intended.
Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FinAccounting AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these terms limits any liability that cannot be limited or excluded under applicable law (for example, liability for death, personal injury, or fraud caused by our gross negligence, where such limitation is not permitted).
Indemnification
You agree to indemnify and hold FinAccounting harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service in violation of these terms or applicable law.
Termination
You may stop using the Service, or delete your account, at any time. We may suspend or terminate access to the Service if we reasonably believe these terms have been violated, or as otherwise permitted by law.
Governing law
These terms are governed by the laws of [insert your governing jurisdiction, e.g. the State of Delaware, USA], without regard to its conflict of law principles, unless a different governing law is required by applicable consumer protection law in your jurisdiction.
Changes to these terms
We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
